Banyule Council Approved Heritage Dwelling

Our client approached us after spending several months navigating the planning process with Banyule City Council in metropolitan Melbourne, without a clear pathway forward. While the underlying proposal was relatively straightforward, it had become complex due to the number of planning controls affecting the site.
The key challenges related to tree removal requirements and heritage considerations, both of which added layers of assessment and documentation to the application. In situations like this, it is not unusual for applications to stall when the relevant planning issues are not clearly identified or addressed early in the process.
Our role was to review the proposal in detail, identify the key planning constraints, and reset the application strategy. This involved clarifying what was actually required under the planning scheme, distinguishing between mandatory controls and negotiable matters, and establishing a clear direction for council engagement.
Once the planning issues were properly framed, we restructured the application approach and worked through the outstanding matters with council. This included responding to heritage and tree-related concerns in a way that aligned with policy requirements while still supporting the client’s intended outcome.
With a clearer and more coordinated planning pathway in place, the application was able to progress through assessment and ultimately resulted in the issue of a planning permit.
This project highlights how complex planning controls can often make simple proposals feel difficult. With the right planning strategy, it is possible to resolve these issues and bring applications back on track, reducing delay and uncertainty for the applicant.
