Cafe in Heatherton

Planning permit amendments are often required as businesses evolve to better meet customer needs while remaining consistent with the original intent of an approved development. For this project, we acted on behalf of our client to prepare and lodge a planning permit amendment application with the City of Kingston for alterations and additions to an existing building to be used as a cafe associated with a plant nursery.

The site already benefited from an existing planning permit for the plant nursery and ancillary cafe. Our client’s proposal sought to amend that permit to alter the cafe layout and patron numbers. Our involvement began with a detailed review of the existing planning permit and approved plans to ensure the proposed amendments remained consistent with Council’s original approval. A key component of the application was demonstrating that the cafe would continue to operate as an ancillary use, supporting the function of the nursery rather than becoming a standalone hospitality venue.

We prepared the town planning report, coordinated the supporting documentation and managed the planning permit amendment application on our client’s behalf. The submission also addressed the proposed alterations to the building in detail. The planning permit was successfully issued by the City of Kingston, allowing our client to expand
the cafe’s offering while preserving the original planning intent. This project demonstrates how carefully prepared planning permit amendments can support the growth of an existing business while ensuring continued compliance with Council’s planning objectives.
